FTC bans hundreds of mortgage assistance and debt relief operations

On the heels of the FTC’s List of Banned Debt Collectors comes the sequel: The FTC’s List of Banned Mortgage Relief and Debt Relief Companies and People. Why would someone be banned? Well, here’s the story.
Debt relief is any program or service – such as debt settlement or debt consolidation – that offers to renegotiate or change the terms of a consumer’s unsecured debt. That means things like credit card or student loan debt. What they offer might include reducing the balance, interest rate, or fees owed. Mortgage relief is similar, but for home mortgages, and can include foreclosure prevention and defense or loan modification.
The law is clear: mortgage and debt relief operations can't charge a fee until after they get the promised mortgage or debt relief results. They also can’t misrepresent their services or mislead people about the results of their programs.
And any company crossing that line will end up in trouble with the FTC – like the student loan debt relief cases just announced by the FTC. Some companies have to pay what we call “monetary relief” – basically, handing over their ill-gotten gains. And some can wind up with limits on their business activities. Companies also are monitored by the FTC to make sure they comply.
But, sometimes, the behavior of a debt relief operation is so egregious that the FTC asks the courts to permanently ban the company or person from the industry. The FTC has sued over 500 companies and individuals who broke the law. Nearly 300 of them have been banned, and there have been hundreds of millions of dollars in judgments. And now that list is public, along with the details of the cases.

Do you have a lot of student debt? Wish it would disappear? You’re not alone. Scammers know that people are struggling with debt. They’re targeting borrowers with phony student loan debt relief schemes that can make things worse.
Today the FTC and the State of Florida announced lawsuits against two student loan debt relief schemes — Consumer Assistance Project and Student Aid Center. The FTC also announced a settlement in a case we wrote about earlier this year.
According to the FTC, Consumer Assistance Project and Student Aid Center promised to get people’s loans forgiven or significantly reduced. Consumer Assistance targeted people online and over the phone, claiming it would get relief through government programs or by disputing loans. Student Aid Center used radio ads, text blasts, and featured ads in search results to promote “Obama Loan Forgiveness.”
But people who paid the companies didn’t get their loans forgiven or reduced. At best, the companies got people’s loans put into deferment or forbearance, where loan payments are postponed but the interest owed on them can keep growing. Student Aid Center made some situations worse by telling people to stop contacting their lenders and pay the company instead. People often ended up paying thousands, but didn’t get the promised relief.
Student loan forgiveness programs are available in very limited circumstances. You can apply for debt relief yourself; you don’t need to pay a company. The FTC has new education materials to help borrowers:
  • Student Loan Debt Relief explains how to spot a debt relief scheme, and what people struggling with student loans can do themselves.
  • Maria and Rafael Learn the Signs of a Debt Relief Scamtells the story of a couple trying to repay debt they accumulated for their daughter’s college education. It’s the latest in a series of graphic novels to raise awareness about scams targeting Latino communities.
  • This list shows every company and individual ever banned from providing debt relief and mortgage assistance relief services by an FTC order.

Esta es una frase muy característica de los pobladores de una parte de Colombia la cual significa variadas ideas pero que hoy se encausarán fundamentalmente al nivel asimilación que tengamos frente a diversas situaciones que experimentamos en general. Se afirma con sapiencia que nuestra serenidad es directamente proporcional al nivel que tengamos de aceptación frente a un hecho o circunstancia por las que pasemos. 


Y es que esto es bien importante puesto que, cuando no aceptamos algo que no podemos cambiar, será muy difícil lograr alcanzar la serenidad para intentar cambiarlo, así como tampoco nos será fácil asimilar la diferencia entre lo que podemos y lo que no podemos cambiar, impotencia que solo se asimilará con la aceptación de tal circunstancia.

Tercos, muy tercos, somos a veces los seres humanos, y por ello en ocasiones diversas tropezamos de nuevo con los mismos obstáculos que en el pasado nos habíamos golpeado, sin entender que hay ocasiones en las cuales, la derrota frente a un evento, se tornará en el renacer de una positiva y fructífera victoria en nuestras vidas.
